Terms of Service

These Terms of Service (“Terms”) govern your use of the iDriveExpress platform, mobile applications, and website (collectively, the “Service”) operated by I Drive Express Private Limited (“iDriveExpress”, “we”, “us”, or “our”), a company incorporated under the Companies Act, 2013 with its registered office at Panjim, Goa, India.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Description of Service

iDriveExpress is a technology platform that connects customers with independent professional drivers (chauffeurs) across the state of Goa, India. Customers use their own vehicle. iDriveExpress does not own vehicles, rent vehicles, or provide transportation services directly. We facilitate the booking, payment, and rating of chauffeur services provided by independent contractors.

Important: Drivers are independent contractors, not employees of iDriveExpress.

3. Account Registration

• You must be at least 18 years old to create an account.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• Notify us immediately at info@idriveexpress.com of any unauthorised use.

4. User (Customer) Obligations

• Provide a legally registered and roadworthy vehicle with valid insurance and pollution certificate.
• Ensure the vehicle has sufficient fuel for the trip.
• Treat drivers with respect. Verbal abuse, physical assault, or harassment is grounds for immediate account termination.
• Pay fees promptly per Section 6.
• Report incidents through the in-app SOS button or by calling our 24/7 support line.
• Not use the Service for illegal activities including but not limited to transporting illegal substances or persons under illegal restraint.

5. Driver Obligations

• Hold a valid Indian driving license (minimum 4 years old) and complete KYC verification.
• Drive the customer's vehicle safely, obey all traffic laws, and respect the vehicle.
• Maintain professional conduct at all times.
• Report any accidents, damages, or incidents to iDriveExpress support within 1 hour.
• Not solicit tips beyond the app or perform trips outside the platform for iDriveExpress-introduced customers.

6. Fees and Payment

Fares are calculated based on the package chosen (Hourly / Daily / Monthly) and communicated upfront at the time of booking. Additional charges may apply for:

• Overtime beyond the booked package duration (charged at hourly rate)
• Toll fees and parking charges (paid by customer)
• Cleaning fees for excessive mess (up to ₹1,000)

Payment is processed through Razorpay, our authorised payment processor. We accept UPI, credit/debit cards, and net banking. Monthly plans are billed on the 1st of every month.

7. Cancellations

• Free cancellation: Up to 30 minutes before scheduled pickup for hourly/daily bookings.
• Late cancellation fee (₹100): Cancelled within 30 minutes of pickup.
• No-show fee (₹200): If you fail to appear at the pickup within 15 minutes.
• Driver no-show: 100% refund + priority reassignment. Report through SOS.
• Monthly plans: 15-day notice required for termination; unused days are prorated.

8. Insurance and Liability

Every active trip is covered by:

• ₹5,00,000 personal accident insurance for the customer and driver
• Third-party liability protection during the trip

iDriveExpress is not liable for: pre-existing damage to your vehicle, mechanical failures, indirect or consequential losses, or acts of God (natural disasters, riots, government orders). Our maximum aggregate liability shall not exceed the total fees paid by you in the 3 months preceding the incident.

9. Prohibited Conduct

You agree NOT to:

• Impersonate any person or misrepresent your identity
• Use the Service to transport illegal goods or persons
• Attempt to reverse-engineer or compromise the platform
• Discriminate against drivers based on caste, religion, gender, or other protected attributes
• Solicit our drivers for off-platform work
• Post false ratings or reviews

10. Intellectual Property

All content, logos, trademarks, and software on the Service are the property of I Drive Express Private Limited or its licensors, protected under Indian and international IP laws. You may not use them without our prior written consent.

11. Termination

We may suspend or terminate your account at any time, with or without notice, if you breach these Terms or engage in prohibited conduct. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (payment obligations, IP, liability, disputes) shall survive.

12. Disputes and Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Panjim, Goa.
